Who is this registration for?

I, the applicant (also referred to hereafter as the "volunteer"), understand that for the purposes of this Waiver, the "Event" is defined as all activities related to the Banff Marathon, Half Marathon, 10km and Virtual running events including but not limited to the primary sporting activity, other associated sporting activities, associated training camps, socials, clinics, kid’s run, expos and gatherings organized by Banff Marathon Inc. (hereafter referred to as the "Event Organizer"). I understand and accept that these activities have foreseeable and unforeseeable inherent risks, hazards and dangers that no amount of care, caution or expertise can eliminate, including without limitation, the potential for serious bodily injury, sickness, disease, contagion including but not limited to COVID-19, permanent disability, paralysis and loss of life. I, the applicant, on behalf of myself, members of my family, my heirs, executors, administrators and assigns, hereby forever release, discharge and hold harmless the Event Organizer, Pinnacle Fitness Inc., Banff Road Race Inc., Athletics Alberta, Banff National Park, Town of Banff its representatives and agents including without limitation, Event sponsors, Event directors, Event contractors, Event producers, municipal, provincial, federal governing agencies, park governing agencies, Event participants, volunteers, all venues in which Events or segments of Events are held, and all other entities associated or involved in the organization or staging of the Event including the officers, directors, employees, heirs, assigns, representatives and agents of any of the above, from all claims or liabilities for death, personal injury, property damage, theft or damages of any kind, howsoever incurred, which arise out of or relate to my participation in, or my traveling to and from, or in any way connected to, the Event and activities and notwithstanding that the same may have been contributed to or occasioned by the negligence of these stated parties. I agree not to bring any claim against the persons or entities mentioned above for any of the claims or liabilities that I have waived, released or discharged herein; and I indemnify and hold harmless the persons or entities mentioned above from any claims made or liabilities assessed against them as a result of my actions during and participation in this Event. I, the applicant, agree to all volunteer responsibilities, any instructions given to you by the Event Organizers and officials of the Event, and the following conditions:

1. The volunteer is aware and agrees to the responsibilities as described in the position description on the Volunteer registration site.
2. The volunteer will adhere to all instructions given by the Event Organizers and Officials.
3. The volunteer warrants to the Event Organizers that on the day of the Event, the volunteer will be sufficiently fit and healthy to fulfil the responsibilities set out in the position description.
4. The volunteer acknowledges that they are responsible for the dependability, safety and correct operation of any personal equipment used during the Event.
5. The Event Organizers reserve the right to refuse entry to the Event or to ask you to cease participation if:
- the volunteer fails to follow instructions given by Event officials
- the volunteer acts in a manner that the Event Organizers and/or Event officials believe:
o may cause injury to the volunteer, a participant or another volunteer;
o may damage or harm the environment;
o the volunteer is unfit to participate in the Event due to:
- the consumption or use of alcohol or drugs
- an injury or illness; or
- the volunteer fails to arrive at the start location at the specified time;
6. If in advance of the Event, if the volunteer wishes not to participate in the Event for any reason, they should inform the Event Organizers immediately.
7. If the volunteer decides to leave during the Event, the volunteer should inform an official of the decision immediately so the Event Organizers can account for all of the volunteers.
8. In the event of cancellation, the Event Organizers will have no responsibility for any costs incurred by a volunteer a result of cancellation including any travel or accommodation costs.
9. The volunteer agrees that personal information will be collected for health and safety purposes.
10. The volunteer agrees that the personal information relating to them can be stored, used by the Event Organizers and its partners in connection with the organization, staging and administration of the Event.
11. Medical information may also be used to allow medical assistance to be given to the volunteer.
12. The volunteer agrees that the personal information relating to them may be used by the Event Organizers and the Event partners (under anonymity) in connection with the compilation of statistical information.
13. The volunteer agrees that their name, image and contact details can be used by the Event Organizers and Event partners for the purposes of:
- adding the volunteer to a mailing list to keep the volunteer informed about the Event, updates of relevant information
- the promotion and marketing of the Event and Event features;
- adding the volunteer to a mailing list to keep the volunteer informed about any future events and services such as leisure activities relating to either similar types of events or activities;
- promotional and marketing material in respect of similar events, other community based activities organized by the Event Partners, (together the "Marketing Information").
- If the volunteer would not like the Event Organizers or Event partners to use the Marketing Information or Personal Information other than for purposes related to the participation in the Event, please e-mail the Event Organizers with this request.
14. The Event Organizers reserve the right to change the course, or make any other amendment to the Event that is deemed necessary to stage the Event. This could include but is not limited to; changing the race route, delaying the race, stopping volunteers on the course until the situation is deemed appropriate to continue, altering the distance of the route, canceling or other measures deemed necessary by the Event Organizer. Any change to the Event will be communicated to the volunteer at the Event or sooner if possible.
15. The Event Organizers will have full permission and licence to any and all photographs, motion pictures, videotapes, recordings or any other record of the volunteer in this Event for any purpose including commercial use, for no cost or charge. The volunteer's email address and contact information will be shared with the Official Event Photographer.
16. In no circumstance shall the Event Organizers be liable to the volunteer, whether for breach of contract, any tortious act or omission (including negligence) or otherwise, under or in connection with the Agreement for any:
- loss or damage;
- loss of profit;
- loss of reputation;
- loss of business, revenue or goodwill;
- loss of anticipated savings;
- pledges made on the volunteer's behalf or by the volunteer to a charity; or
- consequential or indirect loss, regardless of whether the loss or damage:(a) would arise in the ordinary course of events;(b) is reasonably foreseeable; or(c) is in the contemplation of the parties, or otherwise.
17. If there is a conflict or inconsistency between any provision contained in the body of the "RELEASE WAIVER" and any provision contained on the Event website or other locations, except where provided to the contrary in the latter, the "RELEASE WAIVER" will prevail to the extent of the conflict or inconsistency.
18. The Agreement shall be governed by Alberta law, and the parties submit to the exclusive jurisdiction of the Alberta courts.
19. If any provision of the Agreement is invalid or unenforceable, in whole or in part, the validity of the remainder shall not be affected.
20. The Agreement does not create, confer or purport to confer any benefit or right enforceable by any person not party to it.


COVID-19 SAFETY AGREEMENT FOR PARTICIPANTS, STAFF AND VOLUNTEERS

I hereby agree to:

1. To comply with the event COVID-19 Guidelines.
2. To comply with all rules and regulations of the Event, and all laws, rules, regulations, policies and guidelines issued by relevant Public Health Authorities concerning matters of health and safety and specifically as they relate to COVID-19.
3. That when I attend the event, I do not have COVID-19 or any symptoms of COVID-19.
4. To provide my contact details in order to be contacted in the case of COVID-19 to assist with the contact tracing of the virus.
5. That if I contract COVID-19 as a result of attending the event, I am not entitled to any compensation and release the organizers and volunteers of any liability.
6. To symptom screening checks and will let the Organizers know if I have experienced any of the symptoms in the last 14 days.
7. To bring my own equipment, water bottles and hand sanitizer;
8. To avoid physical contact with others, including shaking hands, high fives, etc.;
9. To leave the venue as quickly as possible after I finish.
10. To sanitize my hands upon entering and exiting the venue with soap or sanitizer.
11. To continue to follow social distancing protocols of staying at least 2 meters away from others.
12. To not share any equipment during the event.
13. That continued abuse of the policies and/or guidelines may result in disqualification or suspension from the event.
14. That there are risks associated with attending the event venue and/or participating in race activities.
15. To review the COVID-19 Screening Checklist before each time I attend the event. I confirm that my answers to all the questions in the Screening Checklist are “NO”. If any answers are “YES”, I confirm that I will not attend the event.


COVID-19 SCREENING CHECKLIST

1. Do you have any of the below symptoms:
• Fever
• Cough
• Shortness of Breath / Difficulty Breathing
• Sore throat
• Chills
• Painful swallowing
• Runny Nose / Nasal Congestion
• Feeling unwell / Fatigued
• Nausea / Vomiting / Diarrhea
• Unexplained loss of appetite
• Loss of sense of taste or smell
• Muscle/ Joint aches
• Headache
• Conjunctivitis

2. Have you, or anyone in your household, travelled in the last 14 days outside of Canada to a country or region that is currently restricted for travel by the Government of Canada?

3. Have you or your children attending the program had close unprotected* contact (face-to-face contact within 2 metres/6 feet) with someone who is ill with cough and/or fever?

4. Have you or anyone in your household been in close unprotected contact in the last 5 days with someone who is being investigated or confirmed to have a case of COVID-19?
